SAN ANTONIO, Texas — Two men have been arrested in connection to a sexual assault that reportedly occurred in April earlier this year.
18-year-old Xavier Moreno Cardoza and 20-year-old Delfino Rojas Jr. were both arrested and charged after the victim of the assault made the claims in November.
Sources with MySA say the victim, a 12-year-old girl, told police that she had been given laced drugs and raped by multiple men on April 15.
The girl alleged that she had gone to an unknown apartment with her 17-year-old friend, meeting several men there.
A court affidavit states she was given marijuana and psychedelic mushrooms.
She later told police she thought the drugs were laced because she “began to feel very ‘weird’ and ‘out of it,’” according to MySA.
The girl then told police she realized her friend had left her at the apartment and four men surrounded her.
According to the affidavit, the men began touching her under her clothing and asking her to have a foursome with her.
The girl refused, telling the men she was only 12.
The men allegedly insisted she was lying about her age and that she was 16, according to the affidavit.
The men reportedly continued to touch her until she lost consciousness.
Once arrested, Cardoza reportedly admitted to kissing and touching the 12-year-old girl, as well as giving her hickeys and laying under the covers of a bed with her.
The affidavit states Cardoza also admitted to taking photos and videos of her while in the bed.
Rojas allegedly took marijuana to the apartment and asked the victim’s age when she asked to smoke some.
He told police she looked young, according to the affidavit, and she “looked ‘intoxicated’ and ‘messed up’ at times having trouble walking.”
Rojas reportedly admitted to touching the girl under her clothes and attempting to have sex with her.
Police say Cardoza described the assault to Rojas the next day and said he caught a sexually transmitted disease from the girl.
Cardoza has been Charged with Aggravated Assault of a Child and his bond has been set at $50,000.
Rojas was Charged with Indecency with a Child and is being held on a $10,000 bond.
It is unclear if the other two men allegedly involved in the incident have been arrested or not.
